Effective March 14, 2022, U.S. Customs and Border Protection (CBP) will begin detaining merchandise produced or manufactured by Li-Ning Sporting Goods (Li-Ning) at all U.S. ports of entry based on the allegation that Li-Ning is utilizing North Korean labor in its supply chain.
These detentions are conducted pursuant to the Countering America’s Adversaries Through Sanctions Act (CAATSA), which prohibits the entry of good or articles mined, produced, or manufactured wholly or in part by North Korean nationals or citizens, regardless of where the good or articles were produced.
Importers will have 30 days of notice of detention to prove by "clear and convincing" evidence that the merchandise was not produced with convict, forced, or indentured labor. Failure to meet this evidentiary burden may subject the merchandise to seizure and forfeiture.
